3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Eligibility and Age Verification

You must be at least 13 years old to use the Service. By creating an account, you affirm that you are at least 13 years of age and have the legal capacity to enter into these Terms.

Age Verification: During account creation, you will be asked to confirm your age. Providing false information about your age is a violation of these Terms and may result in account termination.

• Direct messages (in-platform): Recruiters with a Recruiter tier subscription may send you direct messages through the platform to inquire about job opportunities, discuss roles, or network professionally. You can respond to any messages you receive, and you control whether to engage in these conversations

We never sell your email to third parties, but we may share it with trusted service providers solely to send communications and operate the Service in accordance with our privacy practices.

Direct Messaging: Messages sent through our platform are stored on our servers and are subject to our Privacy Policy. You are not required to respond to any messages. We do not share your contact information with recruiters unless you choose to provide it directly in your messages or portfolio.

4. User Content

4.1 Content Ownership

You retain all ownership rights to the content you provide, including your profile information, bio, and any content imported from itch.io, Steam, or added manually. By using the Service, you grant ThekaDex a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content solely for the following purposes:

• Operating and providing the Service to you
• Creating and displaying your public portfolio page
• Generating analytics about portfolio views
• Promoting the Service (with your permission, which you may revoke at any time)
• Complying with legal obligations

This license terminates when you delete your account or remove your game entries, except for: (1) content already shared publicly that may be cached by third parties, and (2) content necessary to comply with legal obligations. We do not claim ownership of your content and will not use it for purposes beyond those listed above.

4.2 Content Responsibility

You are solely responsible for the content you upload or link to the Service. You agree not to:

When you import games from itch.io or Steam, ThekaDex collects publicly available data from the game pages you provide via URL. For itch.io, we collect this data through web scraping. For Steam, we use their freely available API. No account connection or OAuth authorization is required. You are responsible for ensuring you have the right to showcase any games you add to your portfolio.

5.2 Third-Party Platforms

Your use of games and content from itch.io, Steam, or other platforms remains subject to those platforms' terms of service and policies. ThekaDex displays publicly available information and links back to the original game pages.

5.3 Service Limitations

We are not responsible for any issues arising from changes to third-party platforms, unavailability of game data, or limitations those platforms may impose. If a game page becomes unavailable or changes, the information in your portfolio may become outdated.

6. Public Portfolios

Your portfolio at thekadex.com/[username] is publicly accessible on the internet. By creating a portfolio, you understand and agree that:

• Your username, display name, bio, profile picture, and selected game jam entries will be publicly visible
• Search engines may index your portfolio page
• Anyone with the link can view your portfolio
• You control what information is displayed through your privacy settings

7. Prohibited Activities

You agree not to:

• Use automated systems (bots, scrapers) to access the Service without permission
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Abuse the rate limiting or API systems
• Collect user information without consent

8. API and Rate Limiting

To ensure fair usage and service stability for all users, we implement rate limits on certain operations:

• Game Imports: You may import games from itch.io or Steam up to 10 times per hour

9.3 Cancellation and Refunds

• No refunds for renewals or after guarantee period

9.4 Free Tier Permanence

Core portfolio features will always remain free: public portfolio, itch.io sync, basic customization, several games, and basic analytics.

10. Intellectual Property

The Service, including its design, code, logos, and branding, is owned by Leap of Faith Studios Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

Game jam content and metadata synced from itch.io remain the property of their respective owners and are subject to itch.io's terms of service.

11. Disclaimers and Limitations of Liability

11.1 Service Availability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11.2 Data Accuracy

While we strive to accurately sync and display your game jam data from itch.io, we do not guarantee the accuracy, completeness, or reliability of any content on the Service.

11.3 Limitation of Liability

To the maximum extent permitted by law, Leap of Faith Studios Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11.4 Consumer Rights Protection

For Users in the European Union and Other Jurisdictions: Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited by applicable law

For consumers in the EU and jurisdictions with mandatory consumer protections, you retain all statutory rights that cannot be waived by contract.

12. Indemnification

• Third-party API disruptions (including itch.io API outages or changes)

In the event of a force majeure, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to minimize the impact and resume normal operations as soon as possible.

16. DMCA and Copyright Infringement

We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on ThekaDex infringes your copyright, you may submit a DMCA takedown notice.

16.2 Filing a DMCA Notice

18. Artificial Intelligence Features

18.1 AI Services We Use

• X.AI (Grok): Optional text enhancement feature. When you click “Enhance,” only the specific text you choose to enhance is sent to X.AI for processing
• Hive AI: Automatic image moderation for platform safety. All uploaded images are scanned for content safety

18.2 What Data Is Shared

• X.AI (Grok): Only the text you choose to enhance is sent as a prompt. We do not share any other profile information, account data, or personal details
• Hive AI: Only uploaded images are shared for moderation purposes. We do not share profile information or other content
• No other user data, metadata, or account information is shared with these AI services

18.3 Your Rights and Controls

• Don't use the “Enhance” button if you don't want AI processing your text
• Request human review of content moderation decisions
• For both X.AI (Grok) and Hive AI, we instruct these providers not to use your content or images to train or improve their generalized AI models beyond providing ThekaDex features described above
• These third-party providers may temporarily store your data only as needed to process your request, maintain security, or comply with applicable law; they are not authorized to retain it longer or reuse it for unrelated purposes

18.4 AI Limitations

AI suggestions may contain errors. You are responsible for reviewing all AI-enhanced content before publishing.
